Following is the Applicant's response to each of the four items. <br />Application Form. Attached to this letter is a new signature page on which the Notary Public <br />has included the Applicant's trade name. <br />Exhibit N -Source of Leeal Rinht to Enter. If approved, the amendment to M-2001-085 will <br />affect three properties, each with different ownership. The three properties and their owners are: <br />1. Lot 2 of the Corrigan Subdivision, owned by the 120'h Estates Partners, LLP and Ms. <br />Donna Schultejann <br />2. Property with the physical address 11061 East 120'" Avenue, owned by Peter Schibli <br />3. Lot 1, Ted Zigan Pit No. 2, Filing No. 1, owned by the Henderson Water Ski Club, LLC <br />Attached to this letter are: <br />1. A Power of Attorney form, which designates Dave Schultejann as the agent and attorney- <br />in-fact for Peter Schibli in real estate matters regarding the property at 11061 East 120'h <br />Avenue and a letter from Dave Schultejann allowing the Applicant to use that property <br />for ingress and egress to and from the 124'h Estates Sand and Gravel Mine. <br />2. An agreement executed between the Henderson Water Ski Club, LLC and the Applicant, <br />which includes, among other provisions, the grant of a right-to-enter the ski club property <br />so that the Applicant can dredge material from the ski lake and conduct all related <br />activities. <br />3. Letters from Dave Schultejann, as Managing Partner of the 120`x' Estates Partners, LLP, <br />and from Ms. Donna Schultejannn, granting a right to enter Lot 2 of the Corrigan <br />Subdivision. <br />Exhibit P - Municiaalities Within Two Miles. Incorporated area of the City of Brighton lies <br />within two miles of the 124"' Estates Sand and Gravel Mine. The City of Commerce City owns <br />
