This letter responds l <br />to those issues. ~ <br />1. Regarding Mr. Rosenthal's ability to testify about subsidence <br />issues "out-of-state", Mr. Rosenthal informs me that he is not <br />familiar with any subsidence issues in Indiana. Because <br />subsidence issues in Indiana are out of the purview of this <br />Western office, it is not appropriate for Mr. Rosenthal to be <br />knowledgeable of, or testify about subsidence in Indiana. <br />2. You commented that "Craft conveniently did not refer to the <br />report from Aguirre Engineers." Craft .was sent to the site to . <br />evaluate whether subsidence had occurred in the 1 North workings <br />and to discuss the proper application of the Surface Deformation <br />Prediction System Model (SDPS) with Mr. Gerity. He was not <br />requested to do an evaluation of possible causes of damage to the <br />residence, although he did in his report. Craft was not given a <br />copy of the Aguirre report because it is an evaluation of the <br />residence, not a subsidence analysis. As stated in Jim <br />Pendleton's June 2, 1995 memorandum "Mr. Atwoolls report focus's <br />upon examination of the architectural stress occurring at the <br />residence." <br />3. You commented that Senator Gramm was not copied on our <br />August 1, 1995 letter. OSM was requested, by you, to explain why <br />the reference of 300 to 500 feet was used in the OSM response to <br />Senator Gramm. We have no record that the Senator requested <br />additional information. OSM, in an August 1, 1995 letter and <br />with a copy of the map, in an August 31, 1995 letter explained <br />the reference. If you believe the Senator has questions about <br />the reference, it would be appropriate for you to forward these <br />explanations. <br />4. You questioned why OSM has not responded to Carl Gerity's <br />July 13th memo. The memo was attached to your letter dated <br />July 13, 1995 to the Department of Minerals & Geology (DMG) and <br />OSM. DMG has the lead in conducting the technical investigation <br />and would, therefore, be the office to respond. OSM is available <br />
