I think they first approached the division <br />4 in October or November of 1987. Reason-to-believe <br />5 didn't go out until August, until the er..d of July of <br />6 1989. They came in in November of 1988, October, <br />7 November '88, we pr oceeded in August of -- July. <br />B MR. O'CONNOR: They came in and talked <br />9 to the division in November of '88 about cleaning up <br />10 that area? How did the division respond ? <br />11 MR. BANTA: I think that there was <br />12 some confusion at that time. The question that was <br />13 raised by the division in its correspondence -- this <br />14 will' be presented, I believe, by Castle Concrete -- <br />15 that the division was wondering whether the haul road <br />16 was within the permit area. And after further <br />17 discussion they --._the ~.tiivis.i.on .staf:f: accepte.d...:t;hat ,. .. <br />18 the haul road was in the permit area. But the <br />19 correspondence that went back and forth did not <br />20 address the particular problems with the slides or <br />21 buttresses. So I think the issue was lost at this <br />22 point -- and for reasons having to do with staffing, <br />23 et cetera, I don't think that matter was pursued by <br />24 the division beyond that.
