By -- <br />letter dated November 9, 1982, Mr. James McArdle of tY~e <br />Division advised Cotter of certain provisions of the C;otter <br />Mined Land Reclamation Permit ("permit") which may have been <br />violated. By letter dated November 24, 1982, the Divsion <br />notified Cotter that formal hearing would be held on Decem- <br />ber 15, 1982 for the Board toyconsider certain possib:Le <br />violations. <br />The Division has alleged that the following .Facts <br />constitute the violation: <br />a. The temporary waste pile is larger than 1.~4- <br />acres; <br />b. The temporary waste pile is in the wrong <br />location and is spilling into Ralston Creek; <br />c. The cutoff for the uranium content of rock to <br />be placed in the waste pile is .07 percent <br />rather than .015 percent; <br />d. A 1/2 acre unpermitted gravel pit was opened <br />adjacent to Ralston Creek with no topscil <br />salvage <br /> <br />The relevant portions of the permit are Exhibit A, wY~ich <br />contains a legal description of affected land, and Er:hibit <br />E, which contains the Reclamation Plan.
