We have summarized your comments in bold italic text and follow with <br />our response: <br />1. It appears that there are several structures, including the Rural, Cole, and other <br />irrigation ditches, and Gas/Oil well locations within 200 ft of the proposed disturbed area. Also, <br />the Division received a letter on December 31, 2002 from Kerr-McGee objecting to Hall-Irwin's <br />Amendment Application based on their concerns about possible damage to an existing well, their <br />ability to maintain and service this well, and the Applicant's failure to provide for future wells <br />and related facilities. <br />We will fax you the stability analysis for this site by the end of the day. We have reconfigured the <br />mining pods to conform to the stability analysis. Jeff Gregg has met with Kerr-McGee to discuss <br />their concerns. Hall-Irwin and Kerr-McGee are in the process of drafting an agreement that will <br />address Kerr-McGee's concerns. <br />2. The Rural Ditch Company should be notified of the Amendment Application, please <br />provide proof of this notification. <br />Enclosed please find copies of the certified mail return receipts for the Oil and Gas Companies and <br />the Ditch Companies. Please note two of the Ditch Companies were not notified because Hall- <br />Irwin isthe majority shareholder. <br />1900 5.
