Section III - Status of Stipulations (continued) Stipulation No. 6 The operator shall install and begin monitoring one monitoring well located at Drainage Node 22, as shown on Map No. 13. The well shall be completed within the bedrock below the surficial material within 60 days of the permit issuing. Water levels, pH, electro-conductivity, and temperature in this well must be monitored monthly as weather permits , and water quality samples shall be drawn quarterly for the parameters listed in Appendix A. This monitoring data must be submitted to the Division quarterly. The applicant shall submit to the Division a well completion report and monitoring schedule within 30 days after the well is completed. Resolved: Node 22(8-7) was drilled October 30, 1981 and the well completion report was submitted December 11 , 1981 . Results from this site are currently submitted on an annual basis . This stipulation is currently found as Stipulation No. 32 in the 1988 document. Stipulation No. 7 Within 60 days of permit issuance, Colorado Westmoreland, Inc. must provide the Division with a specific crop production standard for the orchard area. Pending Division approval , this standard will be used in evaluating revegetation success within the orchard vegetation type. Resolved: CWI submitted the final plan for evaluating orchard revegetation success on March 2 , 1982. This was approved by the Division on March 31 , 1982. Stipulation No. 8 Within 60 days of permit issuance, Colorado Westmoreland, Inc . must provide the Division with an appropriate, justifiable shrub/tree density standard which will be sufficient to meet the approved post-mining land use for the reclaimed surface. This standard must be based upon a recommendation from the Division of Wildlife, and must include the findings of the technical references/sources used to establish this standard. Resolved: CWI submitted a shrub/tree density standard to the Division on March 2, 1982. The Division approved it on March 31 , 1982. It can be found in Volume 9A of the current permit application. Stipulation No. 9 The operator' s quarterly surface water monitoring reports shall include the water quality testing parameters listed in Appendix A, Baseline Water Quality Monitoring. Resolved: CWI incorporated the Division ' s Baseline Data Collection Guidelines into Volume 4, Table 6, of their permit application. The testing parameters listed in Appendix A have been included in the surface water monitoring. -7-
