All grading and topsoiling of pond shores will be done as soon as practicable by the
Operator. The proposed timetables will be followed as long as mining keeps up with
market conditions. The operator will reclaim based on keeping the Table of Disturbance
within the limits set in the Mining Plan.
There is no acid forming material associated with the mining operation and any refuse will
be disposed of in an appropriate manner.
There are no drill holes or auger holes associated with the project.
The maximum slope in the lake will be at 3H:1V.
wNt r
The disturbances to the hydrologic balance will be minimized by the operator. The
amended land will be mined in the same manner as the existing mine site. The operator
commits to:
1. Comply with all applicable Colorado Water Laws and regulations governing the
injury of water rights.
2. Comply with applicable Federal and State water quality regulations.
3. Comply with any requirements of the Clean Water Act and any requirements that
may be imposed by the Section 404 Dredge and Fill permits.
4. There are no temporary siltation structures associated with the project, except for
settling ponds permitted under the NPDES Permit.
5. There are no earthen dams to be constructed to impound water.
WN"fe
The mine site is situated along the Cache La Poudre River. The river serves as a
corridor for wildlife and numerous species have been sighted as is evidenced by the
Colorado Division of Wildlife. The habitat is mainly confined in other areas adjacent to
the property and the mining of the land in the amendment will not impact the corridor
adversely. The creation of a new lake will positively impact the area by the creation of
new riparian habitat and the addition of new wetlands along the shoreline.
E-2
