And we feel that 100 <br />• feet is a rule of thumb, something that both parties can live with in a <br />sense and it also maintains a continuing (inaudible) -vegetation <br />and that is more or less the logic behind a 100 foot buffer between <br />a maTor tributary and a sand and gravel operation located in this situation. <br />WAYNE SMITH: We have discussed this in some detail, we have reviewed this with the <br />Army Corps of Engineers, and the State Water Conservation people and we have <br />no problems with it and are willing to do so. Anything that you have <br />mentioned so far we have either agreed to, we concur in and there are <br />no problems with it for us. <br />BRAD JAMES: The County has been very cooperative up to this point, in achieving <br />the desires of the staff and cooperating with the staff, the staff concerns <br />of this operation. All parties have tried to approach this thing with a <br />most logical possible manner. We have been operating under time constraints. <br />The reasons for bringing this up in this particular situation is that this <br />staff member believes that a lot of information will be supplied in a good <br />faith manner and will be supplied in an adequate manner and if it isn't, <br />and there is a problem, they can be brought before the Board at a later <br />time. That can be stipulated in the permit. This is a particularly <br />crucial situation due to the nature of the previous mining activities <br />and the potential affects on the overall flood hazards of the area. <br />JOHN WARD: All of these conditions have been discussed with the County and the County <br />has been agreeable, apparently. <br />BRAD JAMES: To my knowledge they have. <br />WAYNE SMITH: That's the reason we are here, to get approval. We have discussed them <br />and they, we concur that we have no problems with them. We are willing <br />to do whatever we have to do and we have discussed them with our engineers <br />on our staff, the state water staff and the Corps of Engineers and <br />they are represented here today if you would like to discuss them. <br />DICK WARD: I wanted to ask, you agreed to a continuance from September to October <br />to do a J.ittle more work on your application. Were the items that you <br />are listing today known to them in September. <br />BRAD JAMES: Not by the middle of September, I did not have a reply to my adequacy <br />letter then. <br />DICK WARD: Ok, and that included these items. <br />BRAD JAMES: It included items related to this sort of problem and there reply <br />caused me more or less (inaudible) a second adequacy letter. <br />
