has occurred on the existing buffer between those two properties due to <br />hing water or flood flows which occurred previously and may need to be <br />rip-rapped as well although this is not a condition yet. No discharge <br />of water is planned or expected, however, the applicant I~as applied for an <br />NPDES Permit. The applicant has also filed for a fugitive dust permit. <br />The Division of Water Resources has commented on the operation and stated <br />that the applicant will need an augmentation plan as well as a well permit. <br />Since the site is being mined wet, no drawdown on the local water table or <br />near by wells is anticipated. Division of Wildlife concerns have been <br />adequately addressed. <br />The staff has the following concerns: <br />Staff believes such concerns should be addressed to the satisfaction of <br />staff andjor Board but does not believe it should interfere with Board <br />approval of the application as long as Weld County is agreeable to <br />the following: <br />1) Submit an indexjvicinity map showing all existing structures on or <br />wit}~in 200 feet of the site and reason or authority to remove existing <br />form structures from the permit area. <br />JOHN WARD: Are there in fact any structures? <br />BRAD DANES: There are structures within the permit area that were not illustrated on <br />the vicinity map in previous, my recollection from previous discussion. <br />JOHN WARD: How about the disturbed land, would it violate the 250 foot zone? <br />Where the actual mining is occurring. <br />BRAD DANES: It is possible, in other words without it being deliniated on there, <br />there is the possibility that certain structures could be harmed. <br />If they are going to be removed fine, but I imagine that it would have, <br />it is not spelled out in the lease that those structures are going to be <br />removed so, I thought that was an unanswered question, whether or not <br />they have the authority to remove those structures as opposed to, but <br />they are structures, not structures that will be placed on <br />the property. There are no, I think that Jolin Slovak's residence is outside <br />of tl~e 200 foot area between the operation permit boundary and Isis home. <br />It may be from 250 to 300 feet. <br />2) The applicant has yet to determine a means of access to the property <br />to be mined on the North side of the St. Vrain Creek, and will need to come <br />in with a technical revision to this permit once access has been determined. <br />Here are the four stages of mining in the St. Vrain Creek (indicating to a <br />map) and the series of ponds that they are proposing to create and this is the <br />
