JOHN WARD: What are the objections? -
SHERMAN BLACH: Why do they need a well permit?
BRAD JANES: The Division of Water Resources letter is included in here.
JOHN WARD: Is the requirement for a well permit law?
DAVE SHELTON: According to the State Engineers interpretation of water law, it is,
it has been discussed before. That is something we are going to let the
State Engineer and the courts - we are not going to force it, but according
to the resolution that the Board passed several months ago, the Attorney
General noted that the State Engineer has required that. It is up to the
State Engineer right now.
LARRY BROWN: Therefore, if we were to go with this stipulation, we should word it that
way.
DAVE SHELTON: We should word it that way, it should be part of, we haven`t worked out any
wording that would be ... say what we are trying to say, and that is -
be it know that the State Engineer has said that you must have it in order
to be legal, the State Engineer will enforce this provision. That basically
is where we are.
LARRY BRbCdN:•,.,. Contingent upon compliance with all......
BRAD JANSS: I should point out that that letter of objection that you are reading is
r`. not submitted on time.
4'
~' l
The hydrologist said he would basically verify the need for the buffers.
~' ; '
ti°,~,•?Q~ The final recommendations for those buffers were after consulting with
+, ,."~ ,
O the Slater Conservation Board.
GEORGE HURD: May I ask Brad a question please?
JOHN WARD: Would you please identify yourself for the record?
GEORGE HURD: My name is George Hurd, (completely inaudible)
BRAD JANES: That wasn' t addressed in their adequacy reply.
JOHN WARD: Brad what about the first allegation in the letter from the attorney's
for the Slovacs, the Weld County under any current finding of violation
or have they paid fines and cured all that problem.
DAVE SHELTON: (Inaudible) so is the entire county.
LARRY BROWN: Civil penalty was issued was it not?
DAVE SHELTON: Yes it was.
LARRY BROWN: $2,000?
BRAD JANES: $1,000, the other deferred upon successful application for permit.
JOHN WARD: And there is a current finding of violation that has not been cured as yet?
DAVE SHELTON: Yeh, I would say so, all pits are not permitted in the county as yet.
