The original performance bond and a copy of the certi- <br /> ficate of insurance shall be submitted to the Board's <br /> Secretary and will be made a part of the permanent <br /> I record file in this matter prior to commencement of <br /> mining operations . <br /> 13. The complete operation shall continually operate within <br /> all applicable rules, regulations , and statutes of any <br /> and all Federal , State and County agencies having juris- <br /> diction over any aspect of the quarry operation. <br /> THE RECLAMATION PLAN shall be as follows and in accordance with the <br /> suggestions of the applicant ' s expert witnesses: <br /> 1 . The faces and benches shall be constructed and/or <br /> finished to conform with regulations of the Colorado <br /> Division of Mines Land Reclamation Board presently in <br /> effect or as amended. <br /> 2. On the benches, the applicant shall place no Tess than <br /> 14 inches of topsoil as defined in the 1972 and 1975 <br /> Thorne Ecological Institute Reports, submitted as Ex- <br /> hibits "0" and "D-1 " and made a part of the permanent <br /> records in this matter. <br /> 3. On the benches , the applicant shall apply organic <br /> fertilizer in a ratio of not less than 20 tons per <br /> acre, but in any case that amount and type of mat- <br /> erial which is capable of sustaining growth of the ' <br /> plant species recommended by applicant's witnesses and <br /> set forth in the 1972 and 1975 Thorne Ecological In- <br /> stitute Reports , submitted as Exhibits "0" and "D-1 " ' <br /> and made a part of the permanent records in this matter. ' <br /> Said growth to be subject to an annual review and eval - <br /> uation which shall he submitted to the Board of Adjust- <br /> ment on or before July 1 of each operating year. <br /> 4. The vertical corners shall be curved and contoured <br /> rather than constructed with sharp angles . <br /> i <br /> 5. Once planted, all vegetation shall be watered and <br /> fertilized until grouch acceptable to the Board of Ad- <br /> justment is established and growth is self maintaining. <br /> 6. As mining is completed on each bench, reclamation of <br /> said bench shall commence imr!rdiately. <br /> 1 <br /> For the purposes of controllin4 dust , the applicant shall shut dorm all <br /> sources of fugitive dust whenever fugitive dust emissions exceed the <br /> applicable standards of the Colorado Division of Mines , State and County <br /> health Departments , or the Colorado Occupational Safety and Health Act <br /> (COSH) . To control dust emmiss ions , the applicant shall employ the <br /> following dust control remedies : { <br /> 1 . Wet drilling or dust suction devices shall be em- <br /> ployed in all drilling operations . <br /> i <br /> 2. Water spray bars shall be installed and operable at <br /> all dust producing points in the crushing operation on <br /> a year round basis. <br /> 3. Watering trucks or other devices shall be employed as <br /> required on areas of the benches and quarry floor where <br /> restoration and vegetation has not taken place. <br /> .5_ I <br /> i I <br />
