The original performance bond and a copy of the certi- ficate of insurance shall be submitted to the Board's Secretary and will be made a part of the permanent I record file in this matter prior to commencement of mining operations . 13. The complete operation shall continually operate within all applicable rules, regulations , and statutes of any and all Federal , State and County agencies having juris- diction over any aspect of the quarry operation. THE RECLAMATION PLAN shall be as follows and in accordance with the suggestions of the applicant ' s expert witnesses: 1 . The faces and benches shall be constructed and/or finished to conform with regulations of the Colorado Division of Mines Land Reclamation Board presently in effect or as amended. 2. On the benches, the applicant shall place no Tess than 14 inches of topsoil as defined in the 1972 and 1975 Thorne Ecological Institute Reports, submitted as Ex- hibits "0" and "D-1 " and made a part of the permanent records in this matter. 3. On the benches , the applicant shall apply organic fertilizer in a ratio of not less than 20 tons per acre, but in any case that amount and type of mat- erial which is capable of sustaining growth of the ' plant species recommended by applicant's witnesses and set forth in the 1972 and 1975 Thorne Ecological In- stitute Reports , submitted as Exhibits "0" and "D-1 " ' and made a part of the permanent records in this matter. ' Said growth to be subject to an annual review and eval - uation which shall he submitted to the Board of Adjust- ment on or before July 1 of each operating year. 4. The vertical corners shall be curved and contoured rather than constructed with sharp angles . i 5. Once planted, all vegetation shall be watered and fertilized until grouch acceptable to the Board of Ad- justment is established and growth is self maintaining. 6. As mining is completed on each bench, reclamation of said bench shall commence imr!rdiately. 1 For the purposes of controllin4 dust , the applicant shall shut dorm all sources of fugitive dust whenever fugitive dust emissions exceed the applicable standards of the Colorado Division of Mines , State and County health Departments , or the Colorado Occupational Safety and Health Act (COSH) . To control dust emmiss ions , the applicant shall employ the following dust control remedies : { 1 . Wet drilling or dust suction devices shall be em- ployed in all drilling operations . i 2. Water spray bars shall be installed and operable at all dust producing points in the crushing operation on a year round basis. 3. Watering trucks or other devices shall be employed as required on areas of the benches and quarry floor where restoration and vegetation has not taken place. .5_ I i I
