C-031-81 <br />Dear Mr. Wiley: <br />Enclosed are three Notices of Violation and one Cessation Order for the New <br />Pryor Strip. <br />The Notices of Violation address failure to post sufficient band in two <br />instances, and failure to certify the mine haul road. The Cessation Order <br />addresses failure to abate previous Notice of Violation no. C-84-164. Please <br />note that this Cessation Order carries a mandatory fine of X750 a day until <br />NOV C-84-164 is properly abated. <br />We have received your Request for Conference on IJOV's C-84-164 and C-84-165. <br />We need to set up an appointment with you to hold these conferences before <br />January 10, 1985. My attempts to establish contact by telephone have been <br />unsuccessful. Therefore, I am requesting that you call me so that we can set <br />up a date. <br />In general, we need to meet in the near future to discuss the condition of the <br />mine site and the standing of American Fuels, Inc. as a permittee. Due to the <br />number and type of violations which have occurred at the mine during the past <br />year a pattern of violations, as defined in Rule 5.03.3(2), may exist and a <br />show cause order may be issued in accordance with Rule 5.03.3. In either case <br />the Division is very concerned about the chain of events and conditions which <br />have led to the current situation. <br />Again, it is imperative that we set up a meeting to discuss these various <br />issues.
