Mr. Mitch Rollings <br />August 5, 1997 <br />Page 4 <br />On Mazch 5, 1996, CDMG received another letter from Elaine Mautz indicating dissatisfaction with <br />the repairs conducted by MCC at the cabin. CDMG requested additional information from MCC by <br />letter dated March 21, 1996, and the requested information was received from MCC by letter dated <br />March 27, 1996. The materials were then forwarded to Mautz by CDMG letter dated April 15, 1997, <br />and CDMG requested a detailed description of pending cabin damage from Mautz. A reminder letter <br />was sent from CDMG to Mautz (dated May 14, 1997) reiterating the CDMG request for a cabin damage <br />itemization. <br />On June 1 I and June 12, 1996, meetings were held with Mautz and MCC representatives at the Mautz <br />property. Letters were sent to MCC and Mautz dated June 21, 1996 outlining follow-up information <br />requested by CDMG from both Mautz and MCC. By letter dated July 10, 1996 the requested list of <br />cabin damages was received by CDMG from Mautz. The requested cabin survey report was received <br />from MCC by letter dated August 9, 1996. <br />On August 9, 1996, CDMG sent a letter to Larry and Elaine Mautz which responded to the issues <br />outlined in their letter of July 10, 1996. On August 12, 1996, MCC sent a letter to Mautz <br />recommending that an independent appraisal be conducted to ascertain the cost of the cabin damage and <br />needed repairs. A CDMG inspection was again conducted at the cabin on August 28, 1996, and it was <br />determined that major structural damage had not occurred. On November 11, 1996, MCC sent a letter <br />to Mautz with a check for $4,000.00 to compensate Mautz for any remaining damage to the cabin. To <br />the best of our knowledge the check was accepted by Mautz and CDMG has not received any specific <br />complaints regazding the cabin since last summer. <br />In summary, minor damage did occur to the Mautz cabin, and this damage can reasonably be attributed <br />to underground mine subsidence. MCC conducted repairs to the cabin and paid $4,000.00 to Mautz to <br />compensate for any remaining damage. <br />Road to Cabin -Certain damage did occur to the road which accesses the Mautz cabin. This damage <br />was not associated with surface activitities conducted by MCC. The CDMG determined that the <br />damage was most likely caused by a local landslide, not subsidence. The damage evaluation was <br />conducted subsequent to the CDMG inspections of August 29, 1995 and September 27-28, 1995. The <br />CDMG letter of September 26, 1995, describes the CDMG conclusion that the slide which damaged <br />the road was probably not subsidence generated. Regardless, MCC conducted various repairs during <br />1995 along the road although such repairs were probably not a matter of regulatory concern. <br />Additional complaints were made regarding this road during 1995. Repairs were offered by MCC <br />(letters dated July 26, 1996 and August 12, 1996), but access was denied by Mautz by letter dated <br />August 5, 1996. <br />General Damage to Roads -The letters received by CDMG from Larry and Elaine Mautz of July ]0, <br />1996, July 27, 1996, and August 6, 1996 indicate extensive damage to roads and property on Jumbo <br />
