Mr. Mitch Rollings <br />August 5, 1997 <br />Page 3 <br />The hydrologic monitoring plan is also reviewed each yeaz when the annual hydrology reports are <br />submitted to CDMG, and the approved monitoring plan for water resources on the Mautz property is <br />in compliance with the applicable regulatory and statutory requirements. <br />Possible Subsidence Damage in the Lone Pine Canyon Area and Outlying Areas - Vazious <br />complaints have been made by Mautz regarding damage to lands and features in the Lone Pine Canyon <br />azea. Specific investigations have occurted and the investigations aze addressed below. <br />Cabin Damage - On November 29, 1994, the CDMG received a copy of a letter from Larry and Elaine <br />Mau[z to MCC indicating concems about damage to a newly constructed Mautz owned cabin located <br />above the MCC mining area. Following receipt of the concem letter, CDMG sent a letter (dated <br />November 30, 1994) to MCC reminding MCC of the applicable legal and regulatory obligations <br />regarding protection of the cabin from subsidence-related damage. Tn response to the CDMG letter of <br />November 30, 1994, MCC submitted Technical Revision No. 74 on December 19, 1994, which <br />provided copies of various notification letters (dated November 9, 1994, November 22, 1994, and <br />December 19, 1994) sent to Mautz, and which provided specific commitments to monitor and survey <br />the Mautz cabin. The Technical Revision was approved on February 17, 1997. The commitments <br />provided in Technical Revision were adhered to by MCC. <br />On August 28, 1995 the CDMG received another letter from Elaine Mautz discussing various <br />complaints, including concems about damage to the cabin. A CDMG inspection was conducted August <br />29, 1995 through August 31, 1995 in response to the complaint letter of August 28, 1995. Some <br />damage was observed at the cabin, and during the inspection, MCC personnel committed to repair any <br />subsidence related damage at the cabin. This commitment was reiterated by letter dated September 1, <br />1995 from MCC to CDMG. On September 6, 1995, MCC sent a letter notifying Larry and Elaine <br />Mautz of MCC's intent to repair and compensate them for any damage to the cabin. Also, on <br />September 6, 1995, Mautz authorized MCC to proceed with cabin repairs. <br />A letter dated September 15, 1995 from Elaine Mautz to CDMG was received which specified cabin <br />damage details and requested compensation for loss of use. Another letter regarding the cabin was <br />received from Elaine Mautz dated September 18, 1995. On September 26, 1995, CDMG sent a letter <br />to Lany and Elaine Mautz which presented the CDMG position on all issues outlined in the August 28, <br />1995 complaint letter received from Mautz. The CDMG letter indicated that damage to the cabin which <br />was caused by subsidence must be repaired by MCC, and that it was the CDMG's understanding that <br />such repairs were in progress. Also on September 26, 1995, CDMG sent a letter to MCC requesting <br />information from MCC to verify cabin monitoring and repair progress. <br />On September 27, 1995, an additional inspection was conducted in response to the Mautz letters of <br />September 15 and 18, 1995. The inspection documented ongoing repair. The information requested <br />in the CDMG letter of September 26, 1997 was received from MCC by letter dated October 18, 1995. <br />
