C-9.5-006 and C-95-007 <br />Dear Mr. Erickson: <br />This correspondence is being submitted to comply with the abatement <br />of NOV Nos. C-95-006 and C-95-007. The field remedial actions <br />necessary to abate both violations have been extended to May 4th, <br />due to inclement weather and muddy field conditions. <br />In the NOVS the Division requested that a Technical Revision be <br />submitted as part of the abatement process. Seneca believes that <br />for both violations a Technical Revision is not necessary or <br />warranted. we feel that the following justifications will prove our <br />point. An abatement plan was submitted for NOV C-93-135 on October <br />13, 1993. This abatement called for a plan to minimize erosion and <br />siltation from the haul road, This plan was approved by the <br />Division on October 18, 1995. No Technical Revision was required <br />for the abatement of that particular NOV. The two NOVS just issued <br />were for similar circumstances. At six different sites within the <br />Seneca ii-w permit area, erosion and siltation exceeded what was <br />allowed by the regulations. The abatement plans for each area will <br />be described later in this letter. <br />The areas which were included in the NOVS occurred along haul road <br />ditches and culverts, and from an area of rough graded spoil and <br />recent reclamation activity.
