res. cAUOL PAHLd~ <br />Page 3 <br />Cctober 10, 1980 <br />Violation 80-27 - Failure to comply with Stipulation #2, attached <br />to Permit #79-53 by the Mined Land I~clamation Board. Failure to su}snit <br />inforniation and plans rarn,;red by this stipulation relative to overburden <br />volumes, haul road drainage, Del Agues Canyon hydrology and shrub plantings. <br />Progress - A11 of the information outlined under NOV 80-28 can <br />also be used to satisfy the abatement conditions required in NOV 80-27. <br />In addition to the work outlined above, TBM has initiated the following: <br />1) Del Agues Canyon Hydrology - `!fie sediment control map contained <br />within the Cctober 7, 1980 amp_ndm~nt sukmission exhibits five groundwater <br />monitoring wells and the school well. Water samples were taken from <br />these and the samples will be analyzed per the MLS2 requirements. In <br />addition, a water sample was taken from a spring in the ill Agues Canyon <br />(shown on U.S. Quad Sheet) and it will be analyzed for the same parameters. <br />At this time four (4) additional wells will be completed in the Del <br />Agues Canyon drainage to further define its hydrologic character. These <br />wells will be located so as to provide information for permit expansion <br />into Section 21 and Section 15. The wells will be logged and m~nits~red <br />in c~liance with the regulations, with well corrq~letion expected by <br />October 17, 1980. <br />Mr. lmbert Brogden of Bishop and Associates has been contracted to <br />perform the pump test to determine the transmissivity of the aquifer. <br />Scheduling of this activity has been problematic but as of this date the <br />testing will be performed during the week of October 20, 1980. <br />2) Haul fd~ad Drainage - This has been satisfied in the information <br />submitted in the technical revisions to the permit and the plan sul~nitted <br />requesting approval to mine to the west. Further information can be <br />found in the October 7, 1980 amendment su]xnission. <br />3) Shrub Plantings - Trinidad Basin Mining, through its consultant, <br />will harvest shrub seeds and attempt to propagate them and then plant <br />the seedlings. The species to be collected will be: snowberry, mountain <br />mahogany, gambles oak, and rubber rabbitbrush. The seedlings will be <br />planted in clumq~s, with 25 seedlings per clump, and 9 clumps per acre. <br />The 25 seedlings will be comprised of six seedlings of each species. <br />If sufficient plant materials do not exist at the site then tube- <br />lings will be purchased and established as above. The planting of the <br />various shrub species is dependent on a•railability and if some species <br />are not available I~II,R will be advised and the plan revised accordingly. <br />4) Facilities Rrea I~clamation - Areas that are actively used for <br />machinery maintenance or coal storage will require additional preparatory <br />
