t <br />In addition, MCC has submitted a minor revision application (MR 224) to upgrade the dewatering <br />borehole light-use road to an access/haul road. In this application, MCC stated; <br />"MCC continues to evaluate the failed fill and once a plan is developed for the final <br />configuration of this road section, MCC will provide it to the Division in the form of a <br />minor revision." <br />In MCC's August 29, 1997, weekly report to you and Dr. Pendleton, MCC also stated; <br />does not expect to <br />"As previously discussed with CDMG staff, MCC does not plan to redesign and <br />reconstruct this road section until a thorough evaluation of the failure is completed and <br />long-term stability can be assured. Analysis and evaluation are ongoing, however, MCC <br />s- <br />construction season. At this time, MCC plans to either reclaim the current disturbance <br />prior to winter, or submit a minor revision to leave an at-grade light-use road in place." <br />MCC believes that the abatement steps for this NOV have been addressed as above, so that this <br />violation should be terminated.
