EXHIBIT D - MINING PLAN NARRATIVE (CONTINUED) <br /> Some areas, as is explained in the next paragraph, will have special setback requirements for any <br /> excavation. Except for those areas mentioned in the next paragraph, mining from the minimum 25' <br /> setback requirement may be undertaken vertically. After mitring for reclamation, all slopes shall be <br /> no steeper than a ratio of 3:I slope. <br /> Special setback, sloping, and mitring requirements shall apply in following areas: <br /> 1. Along Monaco Street and 88th Avenue, and within 200' of any adjacent man made structure, <br /> no vertical mining will be allowed from the 25'setback line. A temporary 1:1 miming slope shall <br /> be allowed, provided any slope within 200' of the man made structure is immediately backfilled <br /> to the previously mentioned above standard after mining has been completed in these areas. <br /> 2. Along the Wyco pipeline, no mining shall occur closer than 50, on either side of the centerline <br /> of the pipeline. Even temporary sloping shall not be steeper than 3:1. <br /> J. From the center of the Bull Seep Ditch, no excavation shall occur closer than 50' on either side <br /> of centerline of the Ditch without permission of the Ditch Company. Even temporary sloping <br /> shall not be steeper than 3:1. The owner of the Bull Seep confirmed these requirements in a <br /> letter dated April 25, 1995 added in Appendix I. <br /> 4. All mining, including sloping, final elevations, improvements, etc. within the "Area 2A - South <br /> Platte River& Berm Area" and the exact location of channel improvements and mining along <br /> the "South Platte River Berm .Area" has been approved in an agreement with the Urban <br /> Drainage and Flood Control District (UD&FCD) added to Appendix I. The conceptual <br /> location of channel improvements shown on the MIIYING PLAN MAP - EXHIBIT C-2. Care <br /> will also be taken to minimize disturbance of the existing ground vegetation and trees in <br /> installing required UD&FCD improvements. <br /> Prior to beginning mining and during mining as required, 6' or greater height chain link fencing will <br /> be installed where necessary to prevent access to the site. Where natural barriers, such as the South <br /> Platte River exist, no fencing will be installed, In areas where adjacent property owners have installed <br /> fencing, Cooley's fence will simply connect to the existing fencing. Two gates will be installed, one <br /> onto 88th Avenue and one onto Monaco Street at the proposed Truck Access Points, Both are shown <br /> on MINING PLAN MAP - EXH BIT C-2. <br /> Page 2, EXHBIT D <br />
