EXHIBIT D - MINING PLAN NARRATIVE <br /> The amended permit area is 190± acres in size and will be excavated to provide sand and gravel. The <br /> depth of the resource is approximately 30'. Other properties in the area have been mined for sand and <br /> gravel, mostly by Cooley, and the additional 10+ acre area proposed in this amended application is <br /> a logical addition to this mining operation. <br /> Cooley is completing mining and reclamation on the property across 88th Avenue under permit M- <br /> 89-066. The permit on the property south of 88th Avenue was amended to include construction of <br /> the conveyor be from that property across this one north to the main processing plant on the north <br /> and west side of the South Platte River. Mining and reclamation on property south of 88th Avenue <br /> is nearing completion, and the mining operations on this property have been initiated. Mining on this <br /> amended permit property is expected to last from five to ten years. <br /> The end use for most of the property will be a water storage reservoir enclosed within a slurry wall <br /> (Part of Area 2A and all of Area 2B), that was installed earlier this year. The portions of the property <br /> (Areas I and 2C), that are not within the slurry wall, will not be sealed off from surrounding <br /> groundwater. The areas not enclosed by the slurry wall will be mined wet. The appropriate <br /> permission from the Colorado Division of Water Resources and/or Water Court will be obtained for <br /> a temporary augmentation plan for evaporative losses. <br /> Area I and parts of Area 2C will be backfilled with sand spoils from material generated on site. If <br /> any permanent lake is left on part of Area 2C, a permanent augmentation plan will be prepared and <br /> followed in accordance with approval from the Colorado Division of Water Resources and/or Water <br /> Court. <br /> Water discharge from areas within the slurry wall will be pumped to either two small lakes along 88th <br /> Avenue that Cooley also owns, into the South Platte River, or into the Bull Seep. Cooley has a <br /> current active and approved NPDES discharge permit for discharge into the South Platte River, and <br /> as Cooley has done in the past, the existing NPDES permit discharge points will be amended through <br /> approval of the Water Quality Control Division for discharge into either of these lakes, the South <br /> Platte River, and/or the Bull Seep prior to any discharge occurring. If discharge to the Bull Seep is <br /> utilized, permission from the owner of the Bull Seep Ditch (Fulton Ditch Company) will also be <br /> obtained. In the event the Water Quality Control Division will not allow the existing NPDES permit <br /> discharge points to be changed, a new NPDES permit will be obtained prior to any discharge <br /> occurring. <br /> The excavation will proceed from south to north and east to west in the phases as shown on the <br /> accompanying MINING PLAN MAP, EXHIBIT C-2. Except for installation of the slurry wall, no <br /> excavation shall occur within 25' from adjacent property lines, although the 25' setback area will be <br /> disturbed by storage of material, installation and maintenance of fencing, internal roads, etc. <br /> Page 1, EXHBIT D <br />
