1) The Division has received your fax response dated 3-5-04 to our verbal <br />request during the per-operational inspection to identify all known ground <br />water wells with in 600 feet of the permit and amended areas. In that <br />letter, you have indicated six registered wells. You have also agreed to <br />replace any of the wells listed, if as a result of the slurry or dewatering <br />process, these wells aze impacted. <br />2) Has the Urban Flood Drainage Control approved your planned expansion, <br />as the operation is with in the South Platt Flood Plain? <br />3) It is the understanding of the Division, that the operator has the <br />appropriate water rights for the project from the State Engineers Office. <br />Please refer to their comments dated 3-3-04 <br />Vn EXHIBITS "H", AND "I" ADEQAUTE <br />VIn EXHIBIT "J" VEGETATION INFORMATION <br />1) Please refer to the letter faxed to you on 3-15-04, from the Natural <br />Resources Conservation Service, USDA dated 3-9-04. <br />VIII) EXHIBITS "K" ADEQAUTE <br />LY) EXHIBTT "L" RECLAMATION COSTS <br />1) Please review the reclamation cost estimate from the Division. We have <br />Adjusted some of your calculations to reflect the cost based on our <br />bonding program. We have also adjusted the indirect cost from the 10% to <br />20%. In the reclamation cost, you have included a cost estimate for a <br />pump station which will consist of a building, parking azea, access road <br />and pump equipment in the amount of $3,SOO,OOO.You stated that these <br />construction will be processed through the local jurisdictions and conform <br />to their requirements including azchitectural and building codes.
