Cottony <br />Division Director <br />Natural Resource Trustee <br />Re: M-1980-183 Amendment # 1 Adequacy Concerns <br />Deaz Mr. Hutton, the Division has reviewed your amendment application to permit # M- <br />1980-183, which proposes to-change the mining plan from wet to dry through the <br />utilization of a slurry wall, and has the following comments. <br />I) EXHIBITS "A" AND "B" ADEQUATE <br />II) EXHIBIT "C" PRE-MINTING & MINING PLAN MAPS <br />1) Rule 6.4.3(9) requires the operator to show the owner's name, type of <br />structure and locafion of all significant, valuable and permanent man made <br />structures contained on the azea of affected land and within two hundred <br />feet of the affected azea. Is the operator in compliance with the above rule? <br />III) EXHIBIT "D" MINING PLAN <br />1) The operator plans to dewater so the site can be mined dry, in addition to <br />the slurry wall. Has the operator obtained a mine water dischazge permit <br />from the Colorado Department of Health and Environment, water quality <br />Control Division? In Exhibit "M" under other permits and licenses, the <br />operator states, "Since the entire site will be lined with slurry wall, no <br />water will escape the site. Therefore, no NPDES permit will be required. <br />Please explain, what will take place to the water being dewatered prior to <br />liner application or if the capacity of the lined pond is exceeded? <br />IV) EXHIBIT "E' -RECLAMATION PLAN <br />1) Under the reclamation plan, you stated, "the proposed reclamation plan is <br />similar to the original plan except that the proposed reclaimed use will be <br />for two or three water storage facilities and no development. Other than a <br />general location of where the third reservoir will be, no actual size is <br />provided. Does the operator have the appropriate water rights for the third <br />reservoir? Is the operator going to submit the actual design for it at a later <br />date through the use of a technical revision? Please explain. <br />2) All top soil that is not utilized within a reasonable (more than one growing <br />season) has to be properly stabilized and seeded <br />3) Please include a noxious weed control plan for the site.
