benches in each highwall and topsoil and revegetate the bench slopes. The Division is aware, per discussion with <br />Steve O'Brian of Environment, Inc., that Clear Creek County may be opposed to reclamation of these highwall <br />azeas and/or future mining of the surrounding "visual berm". The Division is also aware that a substantial <br />volume of rock material would need to be removed in order to establish the needed benches in a manner that is in <br />conformance with the recommendations of the Mazch 2002 Revey Associates, Inc. report. However, the operator <br />is still responsible for implementing the terms of the approved reclamation plan and for providing a bond <br />adequate to assure the completion ofsbch plan. In order forthe operator to resolve this concern, the Division <br />offers the following acceptable options: 1) provide the aterial volumes and associated reclamation costs needed <br />to complete the terms of the approved reclamation pia for each highwall, ie: drilling, blasting, benching, <br />topsoiling, and revegetating, or 2) modify the approve reclamation plan for these particulaz highwalls and the <br />surrounding visual berm to allow the slick rock faces t remain essentially "as is". Under the second option the <br />Division would require a demonstration that.the high all crest is safe for both people and wildlife and that <br />rockfall hazards aze adequately mitigated. With-the el urination of benching requirements for these highwalls, <br />safety fencing and a safety bench or catchment berm a the crest may be required. Without benches at the toe of <br />the highwalls to catch rockfall, the floor of the pit pro osed for future commercial use might be subject to rockfall <br />hazazd. Alternative rockfall control mechanisms may e employed, such as catchment berms at the toe of the <br />slopes.. The Colorado Geologic Survey has develope the "Colorado Rockfall Simulation Program" for computer <br />modeling of rockfall hazazds and design of mitigation easures. The Division requests that the operator clarify <br />and resolve future reclamation plans and associated c sts for these existing highwalls. The Division considers <br />this concern to be a part of the amendment application. Please respond. <br />6.4.12 EXHIBIT L -Reclamation Cost <br />13. The Division is still in the process of evaluating <br />July 31, 2002. In particular, the Division will be ve <br />will be using in-house cost estimating softwaze to c, <br />drilling, blasting, grading, and shaping.
