Canany <br />Acting Division Director <br />The Division has reviewed your July 31, 2002 response to previous adequacy concerns of the Division regarding <br />the above referenced amendment application. Tn order to achieve a decision of approval for your application, you <br />will need to address the remaining concerns listed below to the satisfaction of the Division. As you may know, <br />the decision date for your amendment application has been revised to August 23, 2002. Therefore, we would <br />appreciate a response from you on or before August 19, 2002 to allow adequate time for review. <br />6.4.5 EXHIBIT E -Reclamation Ptan <br />11. It appears that Albert Frei & Sons, Inc.'s {AFSI) intent is to construct several water storage reservoirs at the <br />Walstrvm Quarry at some time in the future. However, design documents and other information pertaining io <br />reservoir adequacy concerns wiIl be addressed via a separate permit modification. Since there is a fair amount of <br />discussion in the mine plan and reclamation plan pertaining to the reservoir construction, and page 4 (item IS) of <br />the amendment application form states "The request also includes two water storage reservoirs ..." the Division <br />requests that the operator clarify that construction of the reservoirs, associated reclamation costs, and end land use <br />for such areas as developed water resources should not be considered a part of this amendment application. Also, <br />Exhibit F -Reclamation Plan Map will need to be revised to show two (2) depressions for indushiaUcommercial <br />use rather than 2 lakes. In the event that groundwater is encountered during excavation at the quarry, AFSI will <br />need to notify the Division within 48 hours and should be prepazed to provide a written demonstration of <br />adequate water rights or approvals as required by the Office of the State Engineer. An alternative to such <br />notification would be for AFSI to commit to staying at least two (2) feet above the groundwater table at ali times <br />during quarry excavation or until such time that AFSI can provide a written demonstration of <br />all permits or approvals as required by the Office of the State Engineer for exposure and/or use of groundwater. <br />PIease respond. ' <br />12. It appears that the operator has no immediate plans and has provided no itemized costs for reclamation of the <br />slick, rock faces noted as West Highwall(a) and West Highwall(b) in the Division's April 8, 2002 inspection <br />report. The current configuration of each highwall is as follows: (a) 497' long x 176' high ~ 83 degrees, and (b) <br />497' long x 348' high @ 40 degrees. Although the operator reports that these highwalls aze stable, the <br />configurations noted above do not adequately meet the requirements of the existing (and proposed) reclamation <br />plans. Under the terms of the approved and proposed plans, the operator would need to construct a series of <br />
