The Board can't assure minimum <br />9 disturbance to water quantity in the area until they <br />l0 know what Battle Mountain is going to use to supply <br />11 water project requirements. They can't know that, <br />12 because Battle Mountain hasn't provided ycu with <br />13 that information. <br />14 UNIDENTIFIED PERSON: Is that somewhat <br />15 independent of the sources? If Battle Mountain says <br />16 x acre-feet of water as its source, you mean, your <br />17 contention is that source matters? We need to know <br />18 where the water is coming from in order to make a <br />19 determination (inaudible)? <br />20 MR. HESS: And the quantity of water. <br />21 Your rule, which you all enacted for some reason -- <br />22 and I have every reason to believe it was a good <br />23 reason -- you enacted a rule that requires you to <br />24 investigate the sources of water that an operator <br />25 intends to use. <br />AGREN, BLANDO & BILLINGS <br />
