Another part of their responsibilities is to <br /> l0 indicate the water source they intend to use. It <br />' 11 may not be the same thing. <br /> 12 The rule is very clear that the Board <br />' 13 h <br />th <br />bli <br />i <br />i <br /> as <br />e o <br />gat <br />on to <br />nvestigate the sources of <br /> 14 water that Battle Mountain will use to supply water <br /> 15 requirements. Since they have not obtained a <br />' 16 reliable source of water or adequate source of water <br /> 17 as of today to satisfy water project requirements, <br />' 1S the Hoard can't possibly fulfill its obligations to <br /> 19 investigate the sources of water. <br />1 <br /> 20 Therefore, the application is <br /> 21 incomplete, it's a substantial incompletion, and <br /> 22 pursuant to another Board rule, the application must <br /> 23 be denied on that basis alone, because an incomplete <br /> 24 application shall be denied. <br /> 25 In addition, the Hoard has the <br />' AGREN, BLANDO & BILLINGS <br /> <br />
