8 rule is to indicate the water rights they intend to
' 9 use. Another part of their responsibilities is to
l0 indicate the water source they intend to use. It
' 11 may not be the same thing.
12 The rule is very clear that the Board

14 water that Battle Mountain will use to supply water
15 requirements. Since they have not obtained a
' 16 reliable source of water or adequate source of water
17 as of today to satisfy water project requirements,

19 investigate the sources of water.

21 incomplete, it's a substantial incompletion, and
22 pursuant to another Board rule, the application must
23 be denied on that basis alone, because an incomplete
24 application shall be denied.
