The monitoring locations for each third parry sampling event shall be <br />designated by DMG in advance of the sampling event``and shall be <br />selected from the following approved monitoring locatidns: <br />a. Groundwater Monitoring Wells M-6, M-7, M-8, M-9, M-12, <br />M-13. <br />b. Surface Water Monitoring Site RS-4. ,~ <br />c. The Lower and Upper Tailings Ponds and the Collection Pond. <br />3. In the event that DMG determines on the basis of third party sampling <br />that monitoring data obtained from the tailings facility 6y BMRI are <br />inaccurate or unreliable, DMG may direct the third party sampling <br />contractor to conduct additional independent sampling and subsequent <br />sample analysis in accordance with the requirements of this MOU, at <br />the sole discretion of the DMG provided that such work is within the <br />work description and budget set forth in the scope of work attached to <br />the Contract. In the event that such work is not within the scope of <br />work, then DMG may propose a change order to the Contract. <br />B. Direction of Sampling Activity <br />1. The DMG, through its project manager, shall direct the sampling and <br />analytical efforts of the third party sampling contractor. <br />2. The DMG project manager shall schedule sampling activitries with the <br />third party sampling contractor. <br />3. The DMG shall provide BMRI a minimum of two working~days notice <br />to coordinate the sampling activity with its sampling personnel or <br />contractor. <br />4. In an effort to facilitate coordination and safe working conditions, third <br />party sampling contractor shall report to BMRI personnel izbtmediately <br />upon arrival at the minesite and shall remain under the direction of <br />BMRI during the course of performing the sampling activity required <br />hereunder. <br />5. Split samples retained by BMRI shall be deemed'by DMG to satisfy <br />any normal required sampling effort scheduled to occur within two <br />-3- <br />
