a detailed scope of work setting forth the frequency, locations, analytical
parameters and procedures to be utilized in conducting the gampling and
analyses hereunder; !!
2. Pay the third party sampling contractor pursuant to the terms specified in the
Contract; and
3. Upon proper notice as specified hereunder, provide access to its facilities to
the third parry sampling contractor for the purpose of conducting sampling
activities required hereunder. Nothing herein otherwise limits BMRI's
authority to restrict access to its facilities.
TV. OBLIGATIONS OF DMG
Under the terms of this MOU, DMG shall:
1. Select, with the concurrence of BMRI, the third party sampling cantractor and
independent laboratory to be used to analyze the samples obtained in the
third party sampling program contemplated hereunder.
2. Direct the sampling and analytical activities of the third parity sampling
contractor retained by BMRI pursuant to the Contract and the requirements
of this MOU;
3. Receive and review data and reports received from the third patty sampling
contractor and provide copies of all such materials to BMRI; and
4. Receive and review invoices issued by third party sampling contractor and
transmit comments to BMRI.
V. ADMINISTRATION OF THIRD PARTY SAMPLE COLLECTION
A. Sampling Location and Frequency
1. Independent sampling, and subsequent sample analysis conducted by
an analytical laboratory retained by the third party sampling~ contractor,
shall be conducted at DMG's direction three times duri~tg the first
three calendar months following final approval of the i No. 006
protocol and the execution of the Contract, twice during the
subsequent three (3) month period, and twice during the final six (6)
months of the term of this MOU.
