Exhibit "D" <br />(h) No water will be used in conjunction with this operation, therefore no source is required. <br />(i) One of the primary reasons to expand this to a 112 operation is to enlazge the minable land <br />available in the permit azea so no ground water will be encountered. Surface water will not be <br />intercepted or disturbed but will just flow uninterrupted downstream as it has done historically. <br />Mining will not affect the quantity or quality of the surface or groundwater systems. There will <br />be no proposed dewatering, sediment containment or chemical treatment system, storm water <br />run-off controls, and groundwater points of compliance. <br />(j) Colorado water laws and regulations governing injury to existing water rights will be <br />complied with by not using any water in this operation, no impoundments or diversions, nor any <br />evaporation from the surface of exposed water since none will be exposed. <br />(k) No refuse, acid or toxic producing materials by mining. this sand body shall be produced. <br />Since none will be exposed or used in this operation no plan to handle or dispose of these <br />materials is needed. This will protect the drainage system from pollution and unsightliness. <br />• (1) As explained eazlier this will be a dry pit operation which by its nature eliminates any <br />disturbance to the hydrologic balance. There will no activities to cause off-site damage. Astable <br />configuration of the reclaimed azea will be part of this operation as the end product will be a dry <br />arroyo, just the same as when the operation started. <br />(m) The deposit will not be processed on-site, but will be processed at various off-site azeas. <br />Since the material will not be processed on-site no process or chemicals need to be described. <br />(n) The primary commodities to be mined extracted are limited to sand and a small amount -6" <br />rock. It will be used only for construction aggregates. No secondary products will be produced. <br />(o) As stated above there aze no incidental products to be involved in the mining/extraction by <br />this operation. The many years of mining verify this. <br />(p) This is strictly a sand operation with the mining done by front end loader or bull dozer. There <br />is no need for explosives, and none will be used. <br />
