Additional Concerns; <br />Will the applicant continue to remove 10 feet of topsoil? Where will the topsoil be stockpiled? <br />The stockpile location(s) need to be shown on the Exhibit E Mining Plan map. <br />Since the existing approved timetable of operations is out-dated, the applicant needs to specify <br />the estimated dates that mining will commence and end. <br />Also, if the operation is intended to be an intermittent operation as defined in C.R.S. 34-32.5- <br />103(11)(b), the applicant should include in this exhibit a statement that conforms to the <br />provisions of Section 34-32.5-103(11)(b), C.R.S. <br />Will the pit be excavated deeper than the approved 15 foot limitation? If, so, will groundwater be <br />encountered? <br />Since the historic 70,000 ton limitation no longer applies, does the applicant wish to remove the <br />commitment not to mine more than 70,000 tons a year? <br />The applicant needs to specify the thickness of overburden, if any, to be removed to reach the <br />deposit. The location of overburden stockpiles must be shown on exhibit E Mining Plan map. <br />Specify the thickness of the deposit to be mined. <br />Will access to the site remain the same as the original application? <br />Specify how much water will be used in conjunction with the operation, and the source of this <br />water (dust control etc.). <br />Will refuse and acid or toxic producing materials be exposed during mining? If so, please <br />describe how they will be handled and disposed of. <br />The original application states that groundwater and/or subsurface water rights will not be <br />affected. Does this still apply? <br />5. Exhibit D -Reclamation Plan - OK - if there are no proposed changes to the original <br />approved reclamation plan. which is described in exhibit E of the original application, then state <br />that the reclamation plan, as originally approved, is still applicable. If reclamation plans have <br />changed (since the applicant proposes to revise the post-mining land use to <br />industrial/commercial) then a new exhibit D must be submitted. <br />6. Exhibit E -new Mining Plan and Reclamation Plan maps have been submitted. However, they <br />are marked as Exhibit C and Exhibit F. They should be Exhibit E Mining Plan and Exhibit E <br />Reclamation Plan. The maps comply with Rule 6.2.1 -General Requirements, but do not comply <br />with other parts of Rule 6.3 (show the location(s) of growth medium and overburden stockpiles, <br />Label the names of owners of record of the surface of the affected area and of the Iand within 200 <br />feet of the affected area, outline and label the existing disturbance, note the location of any man- <br />made structure, etc.). Also, the maps describe the proposed expanded azea as being in Section <br />20-T48N-R11E; Vallie Gravel Pit. Fremont County is not the permittee of the Vallie Gravel Pit, <br />Permit number M-1978-331, so you cannot request a revision of this permit. <br />
