Cattany <br />Acting Division Director <br />The Division completed a technical review of your amendment application. In order to meet the <br />minimum requirements of the AcUConstruction Mineral Rules and Regulations, the following <br />items need to be addressed: <br />1. Application - OK except that it describes the location of the pit in Section 20-T48N-R11E <br />(which is not the same as the approved permit). <br />2. Exhibit A - Need a correct Exhibit showing: a) the legal description which must identify the <br />affected land, specify affected areas and be adequate to field locate the permit area. Description <br />shall be by township, range, and section, to at ]east the nearest quarter-quarter, and b) exhibit A <br />must contain a map showing information sufficient to determine the location of the affected land <br />and must contain the names of all immeadiately adjacent surface owners of record. <br />There appears to be a problem with the location of the proposed site. The applicant's location <br />description is Section 20-T48N-R11E. The location of the Coaldale Pit-District #3 is Section 5- <br />T47N-R11E. It appears the applicant may be asking to amend the Vallie Gravel Co. site which is <br />located in Section 20-T48N-R11E (M-1978-331) or, possibly, the applicant may be asking to <br />amend a terminated county pit (M-1984-117), which was located in Section 20-T48N-R11E. <br />Once the correct location is established, and it does not involve any other pit than M-1978-096, <br />the applicant will need to submit the following: <br />3. Exhibit B - OK -the site description located in the original application under Exhibit D. <br />Additional Concerns; <br />Since 1978, have any permanent man-made structures been constructed or installed within 200 <br />feet of the affected land? If so, each structure must be identified and the owner of each structure <br />needs to be listed in this Exhibit. Also, the structure(s) must be shown on Exhibit E map. <br />4. Exhibit C - OK -the mining plan is described in the original permit under Exhibit B. <br />
