If these test results point to <br />regulated wastes, we would certainly do further testing under the direction of Dr. <br />Harlan. <br />The funds made available through the Mid-Continent Bankruptcy liquidation plan for <br />Other Environmental clean-up and remedition are limited, and at present there are <br />substantial demands on these funds for work at Coal Basin. We are in the process <br />of doing an Environmental Audit, and also of carrying out water sampling requested <br />by the Colorado Department of Public Health and Environment in connection with <br />reclamation activities planned by DMG. These are expensive items, and the Trustee <br />does not have large reserves of cash to draw on for payment. <br />Consequently, given the limited value of testing the split samples from 5!2/96, we do <br />not believe the expense is warranted in light of other significant demands on Mid- <br />Continent's available funds. <br />Conclusion <br />For these reasons, and as stated above, we request an extension of time to <br />complete clean-up of the spills.
