As a reference, on <br />February 11, 2005, the Division of Minerals and Geology approved the Amendment to our <br />original Fort Lupton Sand and Gravel Mine permit, which added 212 acres to the permit area. In <br />the approval letter, it was specified that L. G. Everist, Inc., would submit a Technical Revision <br />prior to mining in each new phase so that bonding could be calculated and added for the phase. <br />We are also submitting groundwater monitoring data as requested by DMG in the Second <br />Adequacy Review of this permit amendment, dated January 14, 2005, Paragraph 5. <br />As I explained in our conversation last week, we are submitting this Technical Revision to bond <br />far the mining and reclamation in two permitted phases, and also for the appropriate reclamation <br />for an additional stockpiling area. The two phases to be mined are the Golden Pit and the Hill- <br />Oakley Pit. In these two phases, we will be putting slurry walls in prior to mining, mine them out, <br />and reclaim them as water storage reservoirs, as per our Amendment. We will bond 100% for <br />the slurry wall construction. In the remaining area to be bonded, which is part of the Swingle <br />South Pit, we only need to stockpile materials - we will not be mining that area yet. These three <br />areas are explained in more detail below and are highlighted on the attached mining plan map. <br />Fort Lupton Sand and Gravel Mine -Hill-Oakley Pit <br />The land area which will be the Hill-Oakley Pit is located adjacent to the north side of the <br />original permitted area. This pit was called the Hill-Eber-Oakley Pit in the Amendment <br />paperwork. We are not mining the Eber property at this time, although it was permitted. The <br />western slurry wall of this revised area will now go along the western boundary of the <br />Oakley property, rather than the western boundary of the Eber property. We have shown the <br />decreased mining area and revised position of the slurry wall on the attached map. We are <br />keeping the option open to mine the Eber property sometime in the future. The total <br />permitted area is 49 acres {including Hill, Oakley, and Eber). We will be mining 35.4 acres <br />(including only Hill and Oakley). The perimeter length of the slurry wall will be 5,354 feet. <br />The average depth to bedrock is 35 feet. So the estimated total area of the slurry wall is <br />187,390 square-feet. The estimated slurry wall liner thickness will be 3 feet. The natural <br />underlying material that we will be keying the slurry wall into is Pierre Shale. There are no <br />fault lines running through the property. This area will be mined and reclaimed as per our <br />approved Amendment, except for not mining the Eber property at this time. <br />LM/FL-TR-Golde n HillOakley-013006.doc <br />
