's Coal Ridge No. 1 Mine. This review was conducted to fulfill <br /> the requirements of Rules 2.08.3, 2.06.2(10). 2.06.3(4), 2.06.5(3), 2.06.7(5), <br /> and 3.02.2(4). <br /> Rule 2.08.3 requires that the Division conduct a review of each permit issued <br /> prior to its mid-term, in this case 1-1/2 years. Based on this review, for <br /> good cause shown. the Division may require reasonable revision or modification <br /> of the permit to ensure compliance with the Act and Regulations. <br /> Rule 2.06.2, 2.06.3, 2.06.5, 2.06.7 require that experimental practices, <br /> mountaintop removal variances, variances from AOC, and variances from <br /> contemporaneous reclamation be reviewed by the Division during the mid-term <br /> review. These Rules are not applicable to the Coal Ridge No. 1 operation. <br /> Rule 3.02.2(4) requires that the Division review the amount of the bond and <br /> the terms of acceptance of the bond. <br /> The original mining and reclamation permit for the Coal Ridge No. 1 Mine was <br /> issued to Storm King Mines, Inc. on November 11 , 1985. with a permit term of <br /> three years. The name of the company was subsequently changed to New Castle <br /> Energy Corporation, An application for permit renewal was received by the <br /> Division on April 12, 1987. Numerous adequacy issues from the previous <br /> mid-term review were outstanding at the time. Following more than a year of <br /> attempts to gain financing, New Castle Energy formally requested a permit <br /> renewal allowing only reclamation activities on January 17, 1989. <br /> The permit for the Coal Ridge No. 1 Mine was renewed on December 10, 1989, <br /> allowing only reclamation activities, and for a permit term of 3 years, At <br /> that time adequacy issues pertinent to the reclamation plan were resolved, <br /> several of which required Stipulations to the permit. Since the renewal took <br /> place no revisions have been approved by the Division, therefore the status of <br /> the permit has not changed. For this reason the Division is requiring no <br /> revision of the permit at this time. <br />
