<br /> <br />The existing operation has been located on roughly 9.5 acres in the east half of an existing <br />40 acre BLM permitted parcel and has unknowingly encroached approximately 310' east <br />of the parcel boundary. The permitted area will be adjusted to allow continued mining on <br />approximately 1.8 acres of the previously encroached area while.,the steepest and western <br />' most 0.85 acres will remain reclaimed and undisturbed. The existing 40 acre permitted <br />parcel will be reduced to the 18.35 acre mining boundary. The site is situated on a west <br />' facing ridge sloping down to the west and bounded on the north and south by a 50' <br />setback from the existing drainage swales. The east boundary is limited to a 200' setback <br />from the existing San Miguel Power Company's overhead transmission lines. The highest <br />' point on the site is located on the east boundary at an approximate elevation of 7,528 feet. <br />An access road located in the northeast comer of the site will be included in the permitted <br />azea and reclaimed but will not be mined. <br />The site will be excavated and reclaimed in two to three acre parcels beginning at the east <br />end of the site. Material will first be removed from the top of the east mining boundary in <br />' the formerly out-of-bounds region and pushed down the hill to the existing processing <br />azea. The top 4 to 6 inches will be stockpiled and seeded for future reclamation. This top <br />down method of excavation will disturb approximately 2.44 acres. Reclamation will begin <br />t prior to continued mining in the existing pit area. This phase may last for 1 to 2 years <br />Phase 2 consists of the area west of Phase 1 and all areas east, north and south of the <br />existing pit within the limits of the mining boundary. Material in this phase will also be <br />excavated utilizing the top down method and stockpiled at the existing processing area~at <br />the entrance to the site. This phase will disturb approximately 9.38 acres and may fast as <br />' long as 10 to 12 years. Reclamation will be implemented in 2 to 3 acre parcels from east to <br />west and from north to south prior to commencement of the third and final phase and will <br />' blend in with the surrounding topography. <br />Phase 3 will consist of all future mining west of the limits of the existing operation along <br />the existing gravel ridge within 200' of the power lines. The top down method of <br />excavation will continue along the existing west-facing ridge within the western portion of <br />the permitted area. The top 4 to 6 inches of topsoil will be removed, stockpiled and <br />' seeded for future reclamation. This phase will disturb 4.24 acres and may last as long as 5 <br />to 7 years. The area will be reclaimed to blend in with the surrounding topography. <br />' The extraction of the desired material in each phase will continue until a 3:1 slope is <br />achieved whenever possible or excavation reaches to within 12 to 18 inches of the <br />underlying Momson Formation. <br />There will be no other authorized uses within the limits of the mining operations until the <br />site has been reclaimed back to it's previous wildlife habitat use. No unauthorized access <br />' will be permitted to the site and a locked gate will be maintained to limit access during <br />periods of non-use. No toxic materials of fluids will be stored or disposed of at the site. <br /> <br />1 <br />
