AM-04 Pre-Hearing Conference Notes May 29, 2003 <br />Henderson Mine and Mill 2 Permit No. M-1977-342 <br />relates to the potential for toxicity to water fowl. Mr. Crosby suggested that US Fish and <br />Wildlife Service (USFWS) and the US Environmental Protection Agency (EPA) be solicited <br />for comments on the future wet cover amendment. <br />2. The DOW favors a management plan for domestic animals on the reclaimed site. <br />DMG discussed the notification procedure for amendment applications. At this time, neither the <br />USFWS nor the EPA are on the list of agencies to be notified. DOW is notified of all permit <br />amendment applications. Other federal agencies are on the notification list, for example the Army <br />Corps of Engineers, so if USFWS and EPA request notifications of applications received by DMG, <br />the Mined Land Reclamation Boazd could entertain their requests. <br />In terms of a management plan for domestic animals, DMG has performance standards that require <br />range management, including grazing restrictions such as fencing, until such time that the affected <br />land is revegetated to establish a diverse, effective, and long-lasting vegetative cover that is capable <br />ofself-regeneration without continued dependence on irrigation, soil amendments or fertilizer, and <br />is at least equal in extent of cover to the natural vegetation in the surrounding area. <br />Following the conclusion of the Pre-hearing Conference, Sandra Brown the Conference Officer and <br />Tom Roan, counsel to the Mined Land Reclamation Board departed. The remaining attendees <br />entered into a discussion of previous, current, and proposed future landfilling at the Henderson Mill <br />Henderson has operated industrial landfills at the mill site since the 1970s. Current landfill <br />operations are described in a DMG inspection report dated 3-34-03 that has been provided to Grand <br />County, along with a map of the current and all previous landfill locations. Henderson described <br />how the current landfill accepts approximately 40 tons of solid waste per year, and is located <br />adjacent to the tailing impoundment that accepts 5 to 6 million tons of mill tailing per year. <br />The inert debris landfill approved by DMG through technical revision TR-12 for the disposal of <br />building demolition debris was discussed. Grand County stated their jurisdiction over the proposed <br />inert debris landfill and reiterated for the record that Henderson must gain Grand County approval <br />prior to on site disposal of building demolition debris.
