I am happy to <br />report that I am sure there has been no violation of the <br />permitted boundary and that corrective action was completed <br />by-and-large, on the same day of my visit or by the weekend. <br />The following responds to the items noted on pages 3 & 4 of <br />the P/PV & Corrective Action notice mailed to the operator. <br />1.) The original plan is comprehensive in scope but was not <br />adequately followed. More specificly the Supervisor for the <br />subcontractor doing the actual blasting and crushing failed <br />to follow the Mining Plan in several details. He has since <br />been removed and replaced by another Supervisor (even prior <br />to receiving your report). C & C Sand Company has always <br />faithfully complied with the Mining Plans on 3 or 4 other <br />Permitted operations under their control. <br />The temporary roadway across the normally dry Red Creek was <br />placed less than 100 feet east of the culverted roadway used <br />for nearly a year. At the direction of the operator, all <br />material was carefully lifted out of the drainageway and <br />deposited on the high ground on each side of the creek to <br />form a permanent barrier blocking any possible use of the <br />trail road. I can assure you that any need for anew cros- <br />sing will be culverted with the excess tubing already found <br />on the site. The problem was easily corrected that day. <br />2.) The culverted roadway forms a natural divide between <br />two drainage points on the site .• In both cases sedimenta- <br />tion ponds were constructed on the day of my visit. They <br />are shown on the revised map I have prepared to accompany <br />the Annual Report (copy enclosed). They are as we discussed <br />on the telephone on the 5th. <br />3.) I am positive that there has been no disturbance out- <br />side of the permitted boundaries. As we discussed on the <br />telephone, the south boundary encompasses all of the problem <br />areas you noted. The fuel storage tank you observed is not <br />used in any manner with the mining operation. The landowner, <br />Robert Stack, advised that the tank, located on a concrete <br />pad has been there since 1975. Its location under a small <br />grouping of pine trees for protection from the direct sun <br />light, is 15 feet from the small (possibly 30 inches-.high) <br />embankment. <br />
