LOng <br />Division Dveclor <br />To aid in your review this memo serves to summarize events leading <br />to the issuance of NOV-C-96-021. <br />The Marr Mine site is mostly reclaimed. One mine foreman, Mr. <br />James Mossman, maintains and performs caretaker duties at the mine. <br />The operator has contracted the removal of approx. 10,000 cu. yds. <br />of coal from the Load Out. No active coal extraction is occurring. <br />The last inspection I was on site, October, Jim and I briefly <br />discussed that he didn't know what kind of hdtrs he would be at the <br />mine site in the future. I mentioned that if Kerr Coal Company <br />planned to keep the mine records at the mine site that we would <br />need to work something out to allow access to the records. We did <br />not resolve this when I left the site in October. <br />No inspection was conducted in November. <br />I arrived at the load out approx. 9:45 am, December 12, 1996. No <br />one was on site and the gate was locked. I drove to the mine site <br />approx 12 miles east. The gate to the mine site was locked and no <br />one was present. I returned to Walden and attempted to call the <br />mine office (in case there was call forwarding on it). No success. <br />I received a phone company recording stating that the number I had <br />called was not accepting calls. So I found Mr. Mossman's home <br />telephone number and tried to contact him at home. <br />I then returned to the load out at approx 10:25 am and conducted <br />that portion of my inspection. At approximately 11:10 am I <br />returned to Walden and tried to contact Mr. Mossman at home. No <br />answer. I continued back to the mine site and conducted the rest <br />of my ground inspection at the mine site. I had noted a key <br />hanging on the gate at the load out so I looked around the gate at <br />the mine site for a hidden key. No success. <br />Once my inspection progressed to the mine warehouse area~I again <br />looked for a potentially hidden key. The mine records are stored <br />in the office in the mine warehouse. The warehouse/office were <br />locked. No sign of a hidden key could be found. <br />
