<br />disttrbed area will be utilized to salvage 4000 cubic yards of <br />recoiling material. <br />Highwall elimination: As stated above, this site was in <br />operation pre-SMCRA and has continued in the same location <br />pest-SMCRA. Colorado has indicated that it may submit an <br />amendment to its' approved Program allowing for the retention <br />of highwalls were all avai]able mar'er.ial has been utilized to <br />eliminate the highwall to the maximum extent technically <br />practical. This "variance" would apply only to those <br />continuous use pre/Post SMCRA tanderground operations such as <br />NKC. However, until such an amendment to Colorado's Program is <br />approved by OSM all highwalls, such as the one located along <br />the southern edge of the NKC disturbed area, would have to be <br />reclaimed to approximate original contour. <br />GENERAL CGMMENTS <br />The inspection clearly indicated that this is a well <br />maintained operation. As noted above, the newly constrctcted <br />clean water ~i.version, located in the Eastern portion of. the <br />disturbed area, should be monitored. Also, upon completion of <br />the reconstruct,ion of the sediment ponds re-certification of <br />the structures will be necessary. <br />No enforcement actions were existing at the time of this <br />inspection nor were any issuad as a result of the inspection. <br /> <br />
