Cartany, Director Division of r.aclamation

Colorado Division of Reclamation Mining & Safety ,
~ Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
(303) 866-3567
FAX (303) 83Z-8106 RECEIVED
FEB 1'2 2001
Dear Mr. Cattany: Division o/ Reciamacion,
Mining and Safety
This letter constitutes not9ce that the Costilla County Cotnmirtee for
Environmental Soundness (CES) objects to the proposed Permit Amendment, DRMS
Permit No. M-88-1 l ,filed by Battle Mountain Gold on October 2006.
We do not believe that the Mined Land Reclamation Board has the authority to
grant Battle Mountain Gold water rights to irrigate the property formerly Icnawn as the
Shalom Ranch. The MLRB cannot grant a change of industrial/mining water to
agriculture use.
The CES contests the assertion by Battle Mountain Gold that the West Pit water
is now of pre-mining quality. We fear contamination of the farmland, which is adj acent
to the school and the Town of San Luis.
Further, the Committee for Bm~ironmental SotmdneSS objects to:
1. A proposal to close the wat.r treztment facility located near the Rito Seco Creek
on the Battle Mountain Gold (BMG) property.
2, A proposal to irrigate the BMG property, formerly known as the Shalom Ranch,
with water that should have been processed through the water treatment plant
which is currently in operation.
3. Any proposed changes chat maybe harmful to or negatively impact the citizens of
Costilla County, especially the town of San Luis.
Sincerely,
Rose Mendoza-Green
President
