Department of the Interior <br />June 1, 1979 <br />Page 2 <br />{r <br />J <br />The mine premises were inspected on April 17, 1979 <br />by a representative of the state regulatory authority. <br />Following such inspection, and a hearing before the <br />Colorado Mined Land Reclamation Board, the operator <br />directed substantial efforts toward the areas of primary <br />concern observed by the representative of the regulatory <br />authority. The primary areas were topsoil management <br />and surface drainage/sedimentation control. A follow-up <br />inspection was conducted by the regulatory authority <br />on May 11, 1979. At the May 23, 1979 meeting of the <br />Mined Land Reclamation Board, the notices of violation <br />issued at the April meeting were confirmed. Following <br />reports by the representative of the regulatory authority <br />and the operator, the Mined Land Reclamation Board commended <br />the efforts of the operator to improve compliance with its <br />permit and with the prior orders of the Board. It was noted <br />by the representative of the regulatory authority that the <br />operator had effected substantial improvement in environ- <br />mental control in the mine area and was in the process of <br />submitting appropriate documentation to the regulatory <br />authority. It was noted that the operator had retained <br />the services of a mining consultant and a soils specialist <br />to assist in preparation of a technical revision to the <br />operator's permit, which would reflect many of the improve- <br />ments in field operation. <br />VIOLATIONS <br />The inspector noted four potential violations: <br />1. Failure to dispose of spoil material in accordance <br />with 30 CFR 715.15(a)(1); <br />2. Failure to properly store topsoil so as to avoid <br />compaction and contamination, in accordance with 30 CFR <br />715.16(c); <br />3. Failure to pass surface drainage from disturbed <br />areas through sedimentation ponds, in accordance with the <br />requirements of 30 CFR 715. 17(a); and <br />4. Failure to construct access and/or haul roads <br />to the mine areas, within required grade restrictions <br />and with adequate drainage, in accordance with 30 CFR <br />715 (1) (2) and (e) (3) . <br />
