The name, address, and phone lllllllber of a contact person who will be
responsible for the operation and accounting of this plan must be provided to the
Division Engineer and Water Conunissioner.
8. This substitute water supply plan may be revoked or modified at any time should
it be detennined that injury to other vested water rights has or will occur as a
result of this plan.
9. An application for a change in water rights and plan for augmentation must be
filed with the Division 1 Water Court within two (2) years of the expiration of
this year's plan (i.e., October 31, 1997) to include, but not limited to, long-term
evaporation losses.
This plan shaft become effective through October 31, 1995 upon written receipt of a
response from you within two weeks accepting the terms of this approval letter. If this plan is
not made absolute by a court action by the expiation date (i.e., October 31, 1995) an annual
renewal of the plan is required. Please contact Dick Wolfe in Denver at 866-3581, or Dave
Nettles in Greeley at 352-8712 if you have any questions concerning this approval. We would
conclude that approval of this plan does not imply a position by our office on any litigation
associated with this case.
Sincerely,
~,, f tj ..~Y~~.-.
Hal D.
