~- <br />Mr. James Miner <br />March 29, 1994 <br />Page 2 <br />1. A well permit must be issued for the gravel pit in accordance with §37-90-137(2) <br />and (11), C.R.S. According to our records, the gravel pit well permit application <br />was denied (13082-AD) on April 7, 1993 for failure to have a valid water supply <br />plan. Please request reversal of this denial when you submit your letter of <br />acceptance. No fees will be assessed for this reversal. <br />2. The total surface area of the groundwater exposed after December 31, 1980 must <br />not exceed 3.3 acres. Uses must not exceed 10.59 acre-feet of evaporative loss, <br />0.63 acre-feet of water lost in tl+e product and 1.40 acre-feet of transit loss. <br />Should the total consumption exceed this amount prior to the expiration date of <br />this plan, an amendment will need to be filed with this office. <br />3. In accordance with amendments to §25-8-202("1), C.R.S and Senate Bill 89-181 <br />Rules and Reg+daGons adopted on Febn+ary 4, 1992, the State Engineer shall <br />determine if the substitute supply is of a quality to meet requirements of use to <br />which the senior appropriation receiving the substituted supply has nomtally been <br />put. As such, water yuality data or analysis may be requested at anytime to <br />determine if the requirements of use of the senior appropriator are met. <br />4. Approval of this plan is for the pu+pose as stated herein. Any additional uses for <br />which the water may be used must first be approved by this office. The historic <br />consumptive use credit from natural vegetation stated herein to offset gross <br />evaporation was based on the assumption that the consumption was from <br />precipitation. Any future additional historic consumptive use credit given (e.g., <br />agricultural water transfer) for this site must consider all previous credits given. <br />5. The replacement water which is the subject of this plan for existing depletions <br />cannot be sold or leased to any other entity. As a condition of subsequent <br />renewals of this substitute water supply plan, the replacement water must be <br />appurtenant to this site until a plan for augmentation is obtained for evaporation <br />tosses attd stream depletions. Ail documents which make the replacement water <br />appurtenant to this site should be recorded with the county clerk.and recorder and <br />must be submitted to this office. All replacement water must be concurrent with <br />depletions in quantity, timing, and location. <br />6. Adeyuate accrnnning of diversion and replacement must be provided E,o the <br />Division Engineer in Greeley and Water Commissioner (Mabel M. Cunning, Star <br />Route 2, 3422 Highway 52, Wiggins, Colorado 80654, 432-5521) on a monthly <br />basis or other interval acceptable to both of them. The accounting form provided <br />with your application is subject to modification and approval by the Division <br />Engineer. All ama+nts shaA be in acre-feet. <br />
