Introduction of new employee, Rocky Beavers. <br />d. Solid and hazardous waste, proposed language to be presented at some future <br />board meeting. <br />e. John Eilts correspondence. <br />f. Pascoe resignation as of January 31, 1983. <br />g. Word processing capabilities of the division, new equipment. <br />h. Unsuitability Petition for Coal/Sunshine Notice .dated January 26, 1983. <br />AGENDA ITEM 4 - FORMAL PUBLIC HEARING, ELBERT COUNTY, FILE NO'S 82-209, 82-210, <br />82-211. 82-212. & 82-208 <br />All persons wishing to give testimony in this matter were sworn by the Chairman. <br />Mr. Robert Gower, Elbert County Attorney, and Mr. Richard Young, County Commissioner, <br />were present to represent Elbert County. Mr. Gower indicated that they had hoped to <br />have prepared for submittal some detailed proposals in connection with some <br />reclamation work in lieu of the penalty that had been assessed by the board. Due <br />to the inclimate weather the proposals were not completed in time for this hearing. <br />Staff presentation was made by Reclamation Specialist Supervisor, Joe Zalkind, <br />recalling for the board that at the December Board Meeting the board assessed a <br />$10,000 civil penalty with all but $3,000 to be suspended. The permits have been <br />issued. Elbert County is requesting the board to extend the deadline for the <br />payment of the unsuspended portion of the civil penalty to allow them time to submit <br />their proposals for alternate reclamation work. <br />It was MOVED that the Formal Public Hearing in the matter of Elbert County's <br />proposal for reclamation in lieu of civil penalty be continued to the April Board <br />Meeting. SECONDED and PASSED UNANIMOUSLY. <br />Entire presentation can be heard on the permanent record, Tape 1 @ 1 thru 25. <br />AGENDA ITEM 5 - FORMAL PUBLIC HEARING MR. B L MALOUFF FILE N0. 82-33 <br />All persons wishing to give testimony in this matter were sworn by the Chairman. <br />Mr. Bill Malouff was present at this formal public hearing, and asked the board <br />to reconsider civil penalty assessed at a previous board meeting. <br />Staff presentation was made by Reclamation Specialist Supervisor, Joe Zalkind, <br />indicating that the civil penalty is currently $10,000. This civil penalty would <br />have been suspended down to $200 had Mr. Malouff posted bond within the dealines <br />set by the board. Refer to ATTACHMENT C for chronology of events leading to this <br />formal public hearing. Staff indicated that the $200 has not been paid to date. <br />Mr. Malouff addressed the board in his own behalf indicating that there was some <br />question in his own mind as to the correctness of the amounts stated by staff. <br />He further indicated that no mining has taken place and that he didn't have any <br />money to pay the assessed civil penalty. <br />
