Renner's <br />letter dated March 2, 1991, on the above subject. We plan to discuss <br />the subject with you and your staff at the Mined Land Reclamation <br />Division (MEAD)-Albuquerque Field Office (AFO) quarterly meeting on <br />April 10, 1991. <br />In the meantime, the Office of Surface Mining Reclamation and <br />Enforcement (OSM) proposes that MLRD notify all permittees with single <br />closed-channel combination principal and emergency spillways that <br />adequate detailed designs be submitted to the Division by May 1, 1991, <br />to bring their sediment pond spillways into compliance with amended <br />Rule 4.05.6(3)(d). The Division would then review the proposed designs <br />for approval/disapproval under technical revision procedures or other <br />appropriate processes. <br />OSM believes that the Division's notification to these permittees should <br />require completed construction and implementation of approved spillway <br />designs in all ponds affected by the amended rule no later than <br />September 1, 1991.
