5. Split samples retained by BMRI shall be deemed by DMG to satisfy any normal required sampling effort scheduled to occur within two weeks of the independent sampling event. The DMG and BMRI shall use their best efforts to coordinate sampling activities ih such a way as to minimize duplication. C. Sample Collection Procedures I. The third party sampling contractor shall prepare a guideline for the conduct of the sampling, based upon a review of the permit monitoring requirements and the Sampling and Analytical Protocol (TR-006). 2. The third party sampling contractor shall observe BMRI complete sampling and filtering of the collected samples. 3. The third party sampling contractor shall accept a ~plit sample to preserve and ship to the analytical laboratory it shall retain for such purpose. 4. The third party sampling contractor shall observe the d$contamination ~ of all sampling equipment, bailing and sample collectibn. 5. The third party sampling contractor shall complete an aficeptance form for each sample, including its appraisal of whether the sampling technique employed by BMRI conforms with the approved TR No. 006 protocol. 6. If the third party sampling contractor refuses to accept said sample and states a specific objection to it, BMRI shall perform jhe sampling a second time. If concurrence cannot be reached after desampling, the sample shall be retained and submitted for analysis, bu't designated as "rejected" and be considered in dispute. 7. The third party sampling contractor shall be responsibly for providing all necessary bottles, reagents, packing, coolers, presdrvation needs, custody forms, and all other sampling materials as needed to conduct said sampling pursuant to the TR No. 006 protocol. 8. The third party sampling contractor shall be responsible for sample preservation, transportation and delivery to the independent analytical laboratory. -4-
