EXHIBIT A SCOPE OF WORK This Scope of Work sets forth the work to be undertaken under the terms of the Agreement for Environmental Consulting Services (the "Contract") and the total costs associated with the work. The purpose of the work is to provide independent oversight and review of the monitoring conducted by Battle Mountain Resource$ at certain monitoring locations associated with its tailings facility at the San Luis Mine located in Costilla County, Colorado. The work will consist of the review of relevant documents, preparation of certain reports and guidelines, the oversight of sampling activities, the analysis of samples obtained in the course of sampling activities and the preparation of summary reports. The work will Yee conducted in accordance with the terms of the Memorandum of Understanding between BMRI and the DMG ("the MOU") and will consist of the following specific activities: Task 1. Pre-Sampling Activities Pre-sampling activities will include the preplaration for sampling at the site by the successful completion of the safety training deemed appropriate and administered by the Colorado Division of Minerals & Geology's Office of Active Mines (previously "the Colorado division of Mines"). The appropriate certification will~be obtained and maintained by the contractor for presentation upon request. The Contractor will also comple a whatever safety indoctrination and/or training as may ~be required and administered by BMRI at its mine site. I~o cost will be invoiced by the contractor for this mandatdd activity. Task 2. Preparation of Sampling Guideline Contractor will prepare specific guidelines for its use in the conduct of the sampling activities. The preparation of this guideline wil]I include familiarization with the monitoring required of BMRI in the permit documents, familiarization with t~e sampling and analytical protocol (TR-006), and the prepparation of a brief letter report summary of the Cbntractor's sampling guideline. The guideline will be s~bmitted to the DMG contract administrator for review aid comment. The guideline will be revised appropriately ,in response to direction from the DMG contract administrator. This guideline will be provided to BMRI.
