Long <br /> Division Director <br />FROM: Jim S <br />SUBJECT: Civil Penalty Assessment for NOV CV-2002-007 <br />DATE: 23 May, 2002 <br />Attached is the file for Southfield Mine's NOV CV-2002-007. Included in the file is a <br />copy of the inspection report, a copy of the NOV, a copy of the NOV Modification <br />Notice, a copy of Southfield's 2002 Midterm Review, a Map showing picture locations, <br />print-outs of some of the pictures (the pictures are digital and aze located at <br />M:\coalUrs\CV-2002-007 Pictures and begin with Dsc00621 as picture 1), a letter to the <br />file from Dave Berry and an Extension of Time for Abatement Notice. <br />On 19 Apri12002 I performed my monthly inspection of the Southfield Mine. The mine <br />was in active reclamation with the facilities area having the topsoil replaced. I proceeded <br />to the azea of the Newlin Creek topsoil stockpile, which is part of the Southfield Mine's <br />disturbed boundary, to see if they had used this topsoil for reclamation. <br />When I started up the road to the pile it became obvious to me that there had been work <br />done to the road in the form of grading. As I proceeded further up the road I noticed <br />what looked like coal material, possibly from the Newlin Creek refuse pile that had it's <br />toe at the side of the road (pictures 23-25). Still further up the road I noticed that an <br />"Arizona Crossing" had been removed and water bazs that were in place for erosion <br />control (as part of an abatement for a prior NOV at the Newlin Creek Mine) were also <br />removed. <br />When I reached the topsoil stockpile (which had been removed) I could seethe difference <br />between the road before Southfield's use and after (pictures 20-22). The road had started <br />to fill in with vegetation and was basically atwo-track. <br />Upon returning to the office on 22 Apri12002 I looked through the maps of the <br />Southfield permit and the road was not on a disturbed boundary map, a road map, a <br />facilities map or any other map relevant to the azea.
