<br />Dear Mr. Laird:
<br />Listed below are adequacy review comments on the Turnpike Mining Resource Amendment Application
<br />AM-01 to Permit Number M-2004-009. The Division of Minerals and Geology (Division) is required to
<br />make an approval or denial decision no later than September 26, 2005, therefore, your response to the
<br />following adequacy review concerns should be submitted to the Division as soon as possible.
<br />Additionally, I will be out of the office from September 19 - 27, so will need to make the decision on
<br />September 16, 2005, unless the applicant waives the decision date to a later date.
<br />As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated
<br />in the local newspaper, and proof of notice to all owners of record of surface lands that are in or
<br />within 200 feet of the boundary of the affected land, easement holders, and owners of structures
<br />within 200 feet of the affected land (i.e. wells, water lines, roads, ditches, etc.). Proof of notice may
<br />be Certified Mail return receipts or proof of personal service.
<br />Rule 6.4.3 Exhibit C -Pre-Mining and Mining Plan M8D(S) of Affected Lands
<br />The amendment application states that "Exhibit C is unchanged from M-200[4]-009." However, since
<br />new Mine Plan maps were submitted, does this statement only refer to the Pre-Mine Plan? The Pre-
<br />Mine Plan map was the primary source of names and addresses of owners of structures within 200
<br />feet of the affected lands for the original permit.
<br />• Have any owners changed since the original permit application? If so, please list the changes
<br />and/or provide a new map containing this corrected information.
<br />• Since this amendment application extends the affected area boundary, please indicate whether
<br />there are any additional structures within 200 feet that have not previously been identified. If so,
<br />please provide the names and addresses for the owners of all structures within 200 feet of the
<br />affected lands, and evidence to the Division that notice of the application was provided to these
<br />owners of structures. Please be aware that Rule1.1(46) defines "Structure, Significent, Valuable
<br />and Permanent Man-made" to include, but not be limited to, "buildings, houses, barns, fences,
<br />above or below ground utilities, irrigation ditches, maintained or public roads, bridges, railroad
<br />tracks, cemeteries, communication antennas, pipelines, water wells, water storage structures,
<br />discharge and conveyance structures, etc."
