The water balance identifies the three (3) sources of water to be <br />obtained from: (1J offsite, (2J recycled tailings slurry, and (3) <br />pit dewatering. The offsite supply is dependent upon a water court <br />' decision on change of use yet to be finalized. A plan-for- <br />augmentation is also apart of this ruling. A second court case is <br />pending to adjudicate nontributary water. At this time, please <br />discuss the following for clarification purposes: <br />a. As the tailings disposal area is to be lined and designed to <br />t recycle incident precipitation from a 205 acre area, is this <br />amount of water considered in the plan-for-augeentation.or <br />temporary substitute supply plan? <br />t b. How is the amount of moisture retained in the tailings <br />considered from a water rights perspective? <br />' RESPONSE: Battle Mountain's proposed plan for augmentation contemplates the <br />consumptive use of 1,641 acre-ft/yr of water. Battle Mountain's <br />proposed temporary substitute supply plan contemplates the <br />consumptive use of 500 acre-ft of water during 1990 fora period of <br />' one year during the initial start up phase. In these water rights <br />filings, Battle Mountain has assumed that incident precipitation on <br />the tailings area and moisture retained in the tailings will <br />' constitute consumptive use of water and has allocated a sufficient <br />quantity of water to cover both potential uses. <br />' EXHIBIT L, RECLAMATION COSTS <br />48. Based upon Exhibit D and Figures C-I1 and C-13, it would appear that <br />a point of maximum disturbance within the tailings disposal facility <br />' is reached near the end of the life of the facility. At that point <br />in time, the configuration of the tails is such that a slope toward <br />the center of the facility has been created. Please include an <br />' estimated cost to grade the entire facility to achieve a 1.5Y grade <br />toward a central, armored ditch, which would convey water off the <br />facility surface to the spillway. <br />RESPONSE: Revised Exhibit L contains a cost for construction of the small low <br />flow channels over the tailings impoundment as per MLRD~ discussion <br />and the responses to comments 41 and 42. <br /> <br /> <br />
