Grand County offers the following comments: <br />First and foremost, Grand County understands that this proposal does not relieve <br />Climax Molybdenum Company of conditions required in M-77-34z related to the <br />Reclamation Plan and Post-Mining Reclamation land use: Specifically, these include the <br />sampling program and construction of a water treatment system. It is our <br />understanding that these will remain a part of the permit. Grand County Board of <br />County Commissioners will be the permit authority that approves the water treatment <br />facility under the jurisdiction of the Administrative Regulations for Areas and Activities <br />Designated-as Matters of State Interest: - - <br />Second, we believe that the construction of the interceptor canal around the tailings <br />impoundment will continue to enhance protection of the surrounding environment. <br />This upgrade will provide improvement diversion ofrun-off within the Climax boundary <br />and improve containment capabilities. This project supports the protection of Grand <br />County waters as endorsed as part of the Master Plan. The proposed improvements are <br />a "use permitted by Special Use Permit", regulated by the Grand County Zoning <br />Regulations Section VI, 6.z and will require an application prior to construction. <br />SECT70N Vl, 6.1 (9) Reservoirs and dams engineered to contain one hundred <br />(ioo) acre feet of water or less; (io) Water diversion structures, ditches and <br />pipeline structures engineered to convey fi}ieen (i5) cubic feet of water per <br />second of time or less; <br />
